Terms and conditions of sale

1 - PURPOSE
The purpose of the present conditions is to define the terms and conditions of sale between placedesepices.com/placedesepices.fr, hereinafter referred to as placedesepices.com, and the customer, from the order to the services, including payment and delivery.
They regulate all the steps required to place an order and ensure the follow-up of this order between the contracting parties.

3 - ACCEPTANCE OF CONDITIONS
The customer acknowledges having read, at the time of placing the order, the general terms and conditions of sale set out on the https://www.placedesepices.com website (www.placedesepices.com). By placing an order, the customer accepts these terms and conditions without reservation. These general terms and conditions of sale govern the contractual relationship between placedesepices.com and its customer, both parties accepting them unreservedly.
These general terms and conditions of sale shall prevail over any other terms and conditions appearing in any other document, except in the event of prior, express and written derogation.
In all cases, the on-line provision of the credit card number and the final validation of the order shall constitute proof of the completeness of the said order in accordance with the provisions of the law of March 13, 2000, and shall constitute payment of the sums incurred by the seizure of the items appearing on the order form.
This validation constitutes signature and express acceptance of all operations carried out on the site. When you tick the box confirming that you have read and accepted the terms and conditions of sale, and when you click on the "ORDER" or "VALIDATE" validation button after the order process, you declare that you accept the entirety of these General Terms and Conditions of Sale fully and without reservation. The data recorded by placedesepices.com constitutes proof of all transactions between placedesepices.com and its customers.

4 - ORDER
Automatic recording systems are considered as proof of the nature, content and date of the order. placedesepices.com confirms acceptance of the order to the customer at the e-mail address provided. The sale will only be concluded once the order has been confirmed.
placedesepices.com reserves the right to cancel any order from a customer with whom there is a dispute over payment of a previous order, or for any other reason.
The information provided by the customer when taking the order is binding: in case of error in the address of the recipient, placedesepices.com can not be held responsible for the impossibility in which it could be to deliver the product.

5 - PRODUCTS
Products are offered while stocks last.
The photographs are as accurate as possible, but cannot guarantee a perfect similarity with the product offered, particularly with regard to colors.

6 - PRICES
For each item, the price indicated does not include transport.
In the order confirmation, the total amount is the definitive price, expressed inclusive of all taxes and including VAT. This price includes the price of the articles, handling, packaging and transport costs.
All offers of products, services and delivery terms, at the prices indicated in euros, are valid only in mainland France, Switzerland and Europe and while stocks last. The prices shown include the applicable French VAT (5.5% or 20%). If one or more rates are increased or reduced during the season, these changes may be reflected in the price of the articles.
A detailed invoice will be sent to you with your parcel.
placedesepices.com reserves the right to modify the prices shown in its catalog at any time.
In French overseas departments and territories (DOM-TOM), territorial collectivities and the Principality of Andorra, customs duties, taxes and fees or various charges for the importation of goods are payable by the recipient upon receipt of the parcel. The amount of these taxes depends on the regulations in force in each destination country. placedesepices.com cannot inform you of their exact amount. It is therefore the customer's responsibility to obtain the necessary information from the local authorities concerned, and to ensure compliance with the formalities specific to the import of goods into the territory of the destination country.

7 - DELIVERY
Delivery will be made by our carriers to the customer's home or to a relay point.
Once the order has been validated, it is no longer possible to change the delivery point. In the event of apparent defects, the customer has the right of return under the conditions set out in this document. War, riot, fire, strikes, accidents and the impossibility of being supplied are considered as cases of force majeure discharging placedesepices.com from its obligation to deliver.

For deliveries by our partner carriers, for reasons of availability, an order may be delivered to the customer in several instalments. In this case, the customer only pays for one delivery. If the customer requires 2 delivery locations, he/she places 2 orders, with the associated delivery charges.

placedesepices.com undertakes to honour orders received only within the limits of available product stocks. Stocks are updated every 24 hours; however, if a product is not available, placedesepices.com will inform the customer as soon as possible.

9 - DELIVERY TIMES
placedesepices.com undertakes to deliver ordered items as quickly as possible. Delivery times are subject to stock availability.
You will find indicative availability on the website: www.placedesepices.com.

Available items are generally dispatched within 24 to 48 hours of receipt of order, sometimes longer during busy periods such as the festive season*:

- Orders placed on a public holiday, or the day before a public holiday, will extend the delivery time by one day.
- In exceptional cases, additional time may be required to validate your payment.
- Parcels to Corsica may take an extra 24 to 48 hours.
- Outside annual inventory closing periods: please consult us.

Delivery times :
In metropolitan France, the delivery time is usually :
- Delivery to a relay point by our partner (light parcel, -20Kg): 3/4 working days (excluding Sundays and public holidays) with no guarantee of delivery times.
- Delivery by Chronopost France, express delivery the next day before 6 p.m.
- Colissimo delivery without signature France, 48h delivery before 13h

Supplier availability :
Our products marked "in stock" are really in stock, with a few very rare exceptions (quantities close to zero, double orders, etc.).
Our products marked "under xx days" may be delivered before this deadline, but very rarely after; our Italian suppliers are closed in August, so this deadline may be extended. We'll keep you informed.

10 - SHIPPING COSTS
Postage is calculated according to the weight of the order, the rate being to the nearest cent the one charged by our suppliers.
Delivery is free of charge from 79€ for metropolitan France in Point Relais.
If you live in the French Overseas Departments and Territories, shipping costs are higher than in mainland France. Any taxes and customs duties payable by the customer are not included.
placedesepices.com does not deliver to POSTAL SECTORS, TERRITORIAL AND DEPARTMENTAL AUTHORITIES.

Products delivered by Point Relais remain with the service provider for 7 days; after this period, or if the customer refuses the parcel, the parcel is returned to us. Our service provider will invoice us for return costs, which we systematically pass on to the customer when the parcel is returned. If the customer wishes to have the parcel redelivered to the Relais to which it was delivered, he/she must send us a cheque for €5.9 + €10 (return costs), i.e. €15.90.

In the absence of these payments, the products remain the property of placedesepices.com and cannot be returned under any circumstances.

once the products have been dispatched, they are no longer under our responsibility but that of the carrier. Please contact the carrier if you have any questions about delays or damage;

11 - SECURE PAYMENT BY CREDIT CARD
You can pay securely by credit card (Carte Bleue, Visa, Mastercard). As soon as we receive your payment, your order will be registered. If an item is unavailable, placedesepices.com will notify you by email as soon as it becomes available.

The order thus validated by the customer will only be effective once the central credit card network has given its approval. In case of refusal, placedesepices.com reserves the right to cancel the order and stop the shipment. In this case, the customer will be contacted by e-mail or telephone as soon as possible. Credit card details are only kept for the time required to process the order. Your account is debited with the amount of the products and shipping costs on the day the order is dispatched.

12 - PAYMENT SECURITY
Your transaction is secured by the Crédit Agricole and 3D Secure servers.

Entering a secure site:
When you are trying to establish a secure connection with the payment website, this payment website offers secure communication and has a valid certificate. 13 - TERMS OF RETRACTATION
The customer has 14 days (from receipt of the goods) to retract the order.(Cancellation form)
In the event of a request for exchange or reimbursement, the customer must return the new item in its original packaging by registered post, together with any accessories, instructions for use and documentation, and the duly completed "Delivery Note" to the following address and only to this address:

Packages returned by cash on delivery will be systematically refused. Promotional products delivered free of charge with orders must also be returned. Otherwise, their value will be deducted from the customer's refund.

Under no circumstances will placedesepices.com be held responsible for the loss or deterioration of packages returned for exchange. In the event of exercising the right of withdrawal, placedesepices.com is obliged to reimburse the sums paid by the customer, free of charge, with the exception of return costs.
Reimbursement is due within a maximum of 30 days.
In the event of failure to comply with the order confirmation obligation, the cooling-off period is extended to three months from the date of receipt of the goods by the customer. If, within this three-month period, confirmation by e-mail is issued, the seven-working-day period runs from the date of said confirmation. The customer returns the package unopened: placedesepices.com will reimburse the package and any shipping costs; The customer returns the product for a reason for which placedesepices.com is responsible: placedesepices.com will reimburse the product and any shipping and return costs;
Products made to order are not subject to retraction, as they are made to order.
The customer returns the product simply because he/she is not satisfied with it: placedesepices.com will reimburse the amount of the product, but the customer is responsible for the return shipping costs.
If the customer requests an exchange for personal convenience, shipping costs remain at the customer's expense. The customer may either exchange the item or be reimbursed. If a replacement is not possible, placedesepices.com will offer either :

- an equivalent item,
- refund your purchase (excluding shipping costs and restocking),
- issue a credit note.

Products subject to grinding are considered perishable and non-reusable, and will not be refunded.

14- PRODUCT WARRANTY
All placedesepices.com products are covered by the manufacturer's warranty (excluding mouth products). This guarantee is reserved for products subject to normal use and is in addition to the legal guarantee applying to any hidden defects in the product sold (Art. 1625 et seq. of the French Civil Code).
Products sold in the European Union under warranty will be replaced or reimbursed upon receipt in our workshops.
Provided that the customer can prove the hidden defect, placedesepices.com is legally bound to repair all the consequences (art.1641 et seq. of the French Civil Code); if the customer applies to the courts, he must do so within a "short period of time" from the discovery of the hidden defect (art. 1648 of the French Civil Code).

Defects and their consequences due to :
- the intervention of a repairer not authorized by the brand;
- failure to comply with the manufacturer's instructions for use and maintenance;
- operating errors or lack of maintenance;
- use for purposes other than those for which the product is intended, in particular professional or collective use;
- any external cause.
placedesepices.com products are guaranteed to be hygienic and genuine. Most of our products are certified Bio/Ecocert and have the Fair Trade label. Products that do not meet these criteria are harvested with respect for local traditions and people.

15 - DISPUTES
In the event of a claim against a product marketed by placedesepices.com, the customer must make a declaration to his insurer. It is the responsibility of the customer's insurer to put together the file and to proceed with recourse against the insurer and placedesepices.com or placedesepices.com itself.

16 - LEGAL INFORMATION: PERSONAL DATA
The personal information collected for the purposes of distance selling is compulsory, as this information is essential for the processing and routing of orders and the preparation of invoices. Failure to provide this information will result in the order not being validated.
Place des Epices strictly applies the new rules protecting you from the RGPD.

17 - DISCRETION POLICY
Through placedesepices.com, the customer may receive offers from other companies or organizations, or be informed of our offers by e-mail, telephone or post. If the customer does not wish to receive such information, simply contact us (indicating name, surname and address):

placedesepices.com may, for commercial reasons, pass on the identity and contact details of service users to a commercial partner.

The customer has the right to request deletion from the placedesepices.com customer file.
The customer's address is used at the time of the order in order to send the invoice and the order in a timely manner.
The customer's telephone number enables placedesepices.com's customer service to contact the customer for order follow-up.

The customer's e-mail address allows placedesepices.com to confirm the customer's orders, as well as any answers given over the phone by customer service.

The customer's banking information (credit card number, validity date) is encrypted. They are inaccessible to third parties.

18 - APPLICABLE LAW AND JURISDICTION

These terms and conditions are governed by French law.

The customer is hereby informed that in the event of a complaint to the Place des Epices customer service department, and in the absence of a satisfactory response or an amicable solution within 60 days, the customer may refer the matter to the Médiateur de la consommation, whose contact details are as follows:

The mediator's mission is to attempt, independently and impartially, to bring the parties together with a view to reaching an amicable solution. However, the customer remains free to accept or refuse mediation and to bring the matter before the competent courts.

Customers are also informed that they can use the European Online Dispute Resolution (ODR) platform to settle their disputes: www.ec.europa.eu/consumers/odr/.

All disputes will fall under the exclusive jurisdiction of the competent court in Nice, with the exception of disputes concerning natural persons, for which the legal rules governing the attribution of jurisdiction apply. The consumer may bring the matter either before one of the courts having territorial jurisdiction under the French Code of Civil Procedure, or before the court for the place where he resided at the time the contract was concluded or at the time the harmful event occurred.

19 - STORAGE AND ARCHIVING OF TRANSACTIONS
Purchase orders and invoices are archived on a reliable and durable medium in such a way as to correspond to a faithful and durable copy in accordance with article 1348 of the French Civil Code.

20 - PROOF
The computerized registers, kept in the computer systems of placedesepices.com and its partners under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties.

21 - DURATION
The present conditions apply for the duration of the online services offered by placedesepices.com.

22 - COMPLETENESS
Should any of the clauses of the present contract become null and void as a result of a change in legislation, regulations or a court ruling, this shall in no way affect the validity of and compliance with the present general terms and conditions of sale.

23 - INTELLECTUAL PROPERTY
All elements of the placedesepices.com site, whether visual, textual or sound, including the underlying technology, databases, are protected by copyright, trademarks or patents.
They are the exclusive property of placedesepices.com. The customer who has a personal website and wishes to place, for personal use, on his website a simple link directly to the home page of the placedesepices.com website or to any other page, must request authorization from placedesepices.com.
This will not constitute an implicit affiliation agreement.
On the other hand, any hypertext link to placedesepices.com using framing or in-line linking techniques is strictly prohibited.
In all cases, any link, even if tacitly authorized, must be removed by simple request from the placedesepices.com company.

24 - LIABILITY
placedesepices.com has, for all stages of access to the site, the ordering process, delivery or subsequent services, only an obligation of means. placedesepices.com cannot be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, external intrusion or the presence of computer viruses, or for any event qualified as force majeure, in accordance with jurisprudence.
